As we reported yesterday, we have been engaged in a battle with "Dr. Chaps" Gordon Klingenschmitt for several weeks now, stemming from Klingenschmitt's mistaken belief that the videos we have been posting featuring excerpts from his television program are violations of his copyright. As a result, Klingenschmitt has filed multiple copyright claims against our YouTube account and succeeded in shutting it down on two separate occasions.
In both instances, we have filed counter-claims against each and every alleged violation and every one has been resolved in our favor, resulting in our account being restored and the strike against us being removed.
Fed up with his on-going campaign to hamper our work, our lawyers have sent Klingenschmitt a cease and desist letter explicitly warning him that if he continues to file bogus copyright complaints against our YouTube account, legal action will be taken against him.
But, according to an interview Klingenschmitt conducted with David Pakman yesterday, it doesn't appear as if he has any intention of ceasing his campaign to permanently shut down our YouTube account by relentlessly filing bogus copyright complaints against our videos.
Insisting that we are "stealing" his content and trying to pass it off as our own in an effort to make money, Klingenschmitt amazingly asserted that we have been filing a "false counter-claim knowingly infringing on my copyright" by responding to his bogus copyright claims and getting our videos restored on YouTube.
As such, Klingenschmitt states that he has been in contact with lawyers of his own who have allegedly recommended that he sue us, but that is not a course of action that he intends to pursue at this time, he said, though he does intend to continue to file copyright claims against our videos and have them removed from YouTube.
When Pakman pointed out that we cannot be expected to moderate the thousands of comments our videos receive on YouTube nor be held responsible for what anonymous users might post in those comments, Klingenschmitt insisted that we do, in fact, moderate the comments and have removed comments from people supporting him. He even claims to have screencaps that prove it, which is pretty amazing considering that that has never happened.
Pakman's interview with Klingenschmitt was very fair and even-handed, but we would like to address the hypothetical argument he raised that the videos we post to YouTube might not be protected by Fair Use since we are not adding any commentary or criticism.
The entire purpose of posting these brief video clips to YouTube is so that they can serve as the focus in blog posts written here on RightWingWatch where we provide commentary, context, and criticism. Each video uploaded to our YouTube account makes clear that the clip is being posted as part of our regular news reporting to highlight and expose the outrageous statements made by key figures in the right-wing movement and includes commentary on the statements highlighted in the video. As the most popular video sharing site, posting our clips to YouTube makes our reporting available to the broadest swatch of people so that it can easily be shared with other bloggers, activists, and media outlets. In addition, our videos also include a link to the relevant RightWingWatch blog post in which it is being used, which contains further commentary, context, and explanation.
There can be no question that our video clips are used for an entirely different purpose (reporting and commentary) than Klingenschmitt's original purpose, which is to spread his radical, right-wing, anti-gay views and agenda, further making clear that our videos are protected by the doctrine of Fair Use.
Several months ago, "Dr. Chaps" Gordon Klingenschmitt took issue with this blog and the videos we had been posting on YouTube, accusing us of issuing death threats against him because of random comments posted by anonymous users on YouTube.
As we explained at the time, we neither read nor moderate the comments posted on YouTube and we have a disclaimer right on our YouTube page which states that "we in no way support or endorse comments written by third parties and are in no way responsible for them."
On today's "Pray In Jesus Name" program, Klingenschmitt was worrying that the recent implementation of the "nuclear option" in the Senate would result in President Obama packing the federal courts with anti-gun judges. That somehow morphed into a discussion of state laws regarding the right to carry a weapon, which bizarrely ended with "Dr. Chaps" warning this blog specifically that he recently obtained a concealed carry permit.
Declaring that he is a twenty year military veteran and was captain of the rifle team in high school, Klingenschmitt went on to inform us that he recently got a concealed carry permit, saying "so for those of you watching on RightWingWatch and issuing death threats against me, just know that if you come to my home and you threaten my wife, that I will defend myself and my wife."
On the bright side, he did also promise "to pray for your soul, I pray that you go to heaven":
For the last month, we have been locked in a battle with "Dr. Chaps" Gordon Klingenschmitt stemming from a series of bogus claims that he filed against our YouTube channel, claiming that we had been stealing and misrepresenting his copyrighted content.
In early November, Klingenschmitt filed multiple claims against our account, resulting in our entire account being terminated by YouTube. We immediately filed counter-claims against all of Klingenschmitt's complaints, asserting that our videos were protected by Fair Use and, two weeks later, after Klingenschmitt failed to pursue his bogus claims in court, our account was restored.
But just one day later, Klingenschmitt filed another series of false copyright claims against our account and got our account terminated once again. Just as before, we filed another round of counter-claims against all of his copyright notices and, late last week, our YouTube account was restored for the second time.
As such, last week Klingenschmitt was mailed a cease and desist letter [PDF] on our behalf informing him about Fair Use and explicitly warning him that if he continues to file bogus copyright complaints against our YouTube account, legal action will be taken against him:
Over the past several weeks, you have filed a series of Digital Millennium Copyright Act (“DMCA”) takedown notices with YouTube targeting video clips taken from your video program, PIJN News. DMCA takedown notices only should be lodged when a copyright owner has a legitimate belief that the challenged material is infringing their copyrighted works. You have no legitimate basis to hold such a belief and, therefore, should not have lodged the notices with YouTube. The videos you have challenged are protected by the fair use doctrine and therefore are non-infringing. 17 U.S.C. § 107 (“the fair use of a copyrighted work . . . for purposes such as criticism [and] comment . . . is not an infringement of copyright.)
Based on this legal analysis, your conduct and public statements, it appears to PFAW that you have lodged the DMCA notices not out of any genuine concerns for your copyrights, but rather for the purpose of causing YouTube to take down the RWW YouTube channel. You have publicized your campaign, and made clear that your efforts are motivated by your political disagreements with both RWW and some of the independent comments posted on the RWW’s YouTube account. RWW has challenged every takedown notice pursuant to YouTube’s counter-notification process, and every video has been restored following the statutory waiting period without any legal action for copyright infringement having been initiated by you. Nonetheless, you continued to submit separate notices, for multiple videos which appears to PFAW to be calculated to rapidly take down the account and disrupt PFAW’s business. Because YouTube has a publicly-stated policy of taking an account offline after three DMCA notices, your unfounded copyright allegations have caused YouTube to take down the RWW account entirely – twice. Based on your public statements, there is little doubt that this was your intended goal.
Your conduct with respect to the RWW YouTube channel must cease immediately. You are on notice that PFAW’s use of your videos constitutes fair use and that the DMCA provides that misuse of its procedures to shut down lawful speech can result in liability for “any damages, including attorneys’ fees and costs” that result. A number of other legal remedies also are available.
Our videos are protected by Fair Use and we intend to continue our efforts to report on the radical views and agenda of Religious Right activists. As such, we will keep posting videos like this of Klingenschmitt railing against Obamacare on his program today and repenting for a nation that treats "the president as if he is a healing god [when] he is not; he's an imposter, he's a liar, and he causes cancer through his policies":
In an email today to members of his Pray In Jesus Name organization, far-right pastor Gordon Klingenschmitt claims that an anti-bullying measure in Congress will lead to the sexual molestation of children.
He said that a non-discrimination bill backed by Sen. Al Franken and Rep. Jared Polis should be called the “‘No Child Left Unmolested’ amendment,” warning that the lawmakers are “recruiting your kids” and “bullying public school kids aggressively.”
He even compared Franken, who is Jewish, to the Nazis: “Franken’s ‘No Child Left Unmolested’ amendment will teach your kids to violate your Christian values, and like the Brownshirts teach your kids to report YOU as a hater or bully, if you fail to endorse homosexuality as normal. Is there no end to their depravity?”
This summer Franken snuck his pro-bullying legislation which threatens to defund any public school that fails to promote homosexuality (bullying Christian kids to reject their parents' religious beliefs), by inserting the language from his failed "Homosexual Classroorms Act" (aka Student Non-Discrimination) into Senator Tom Harkin (D-IA)'s Elementary and Secondary Education Act (formerly known as No Child Left Behind).
The result is Al Franken's "No Child Left Unmolested" amendment, which mandates a pro-homosexual federal curricula for all public schools, and defunds any school that resists. He deceptively campaigns it will stop bullying, but actually it bullies your Christian kids and teachers, removing power from parents and school boards, by threatening to withhold funds, if they refuse to teach kids that sin is normal.
Sadly, this move will complete step 4 of 5 in the gay agenda's plan to transform America. They've already completed 3 steps, having passed their Hate Crimes Law, repealing Don't Ask, Don't Tell, and striking down DOMA at the Supreme Court this week. Al Franken's Homosexual Classrooms is next, recruiting your kids against your beliefs. Finally ENDA will soon bankrupt Christian businesses.

It is no secret that "Dr. Chaps" Gordon Klingenschmitt is vehemently opposed to any efforts to protect the rights of transgender students in public schools (or anywhere else, for that matter), asserting that letting a transgender student to use the bathroom or locker room is to essentially allow her to visually rape her fellow students.
Klingenschmitt returned to the issue on today's "Pray In Jesus Name" program where he highlighted the situation involving Coy Mathis to accuse her parents of abusing her by dressing her as a girl because "they have a political agenda to push these co-ed bathroom bills into Colorado state law."
"He's being abused by his parents," Klingenschmitt asserted. "These abusive parents now have used this little boy to try and claim that he's a girl to try and tell the world that they ought to let transgender adults into your little girl's public bathrooms!"
"There is a demon of rape inside of this movement," he added, "to violate your daughters":
WASHINGTON – People For the American Way (PFAW), a national progressive nonprofit advocacy group, has launched a petition urging YouTube to change its video takedown policy in response to a barrage of frivolous complaints aimed at PFAW’s Right Wing Watch YouTube channel.
On November 7, YouTube automatically terminated the channel of PFAW’s Right Wing Watch blog after Pastor Gordon Klingenschmitt, a right-wing activist who is a frequent subject of Right Wing Watch’s reporting, made a number of frivolous copyright claims against the account. On November 20, the channel was restored following YouTube’s procedure for challenging such false claims. Within a day, Klingenshmitt filed another series of complaints, causing the channel to be suspended yet again.
“We must be doing something right if right-wing, anti-gay activists are so eager to silence our voice,” said Michael Keegan, President of People For the American Way. “But we can’t allow a hatemonger like Klingenschmitt to hide his record of dangerous, bigoted rhetoric simply by filing a few false complaints. We appreciate the service that YouTube provides and have made it a central part of our work monitoring and exposing the radical right. Although we distribute our videos through multiple channels, YouTube is an important network for sharing this information. It’s disappointing that a single activist with a grudge can exploit a loophole in YouTube’s policies to bring down the work of an entire watchdog organization.”

YouTube’s policy requires the automatic removal of an account if three challenges have been filed against theaccount simultaneously. Klingenschmitt has previously attempted, unsuccessfully, to get individual videos of himself removed from Right Wing Watch’s channel. Other right-wing figures have similarly attempted to abuse YouTube’s policy to hide videos of themselves; all the challenged clips have ultimately been restored.
Right Wing Watch’s YouTube channel holds thousands of videos that have collectively received more than 20 million views.
“Klingenschmitt’s attacks speak to the success we have had in monitoring and exposing extremism on the right,” added Keegan. “However, unless YouTube changes its policy to prevent serial frivolous copyright claims from people like Klingenschmitt from taking down accounts, we will continue to risk losing valuable reporting for any reason at any time. YouTube should not allow extremists to silence the watchdogs reporting on their extremism.”
Even though Gordon “Dr. Chaps” Klingenschmitt has lost every single claim of copyright violation he has filed against our YouTube page, due to YouTube’s processing system he is able to take the account offline by repeatedly making bogus copyright claims.
Just one day after YouTube rejected Klingenschmitt’s earlier complaints and restored our account, the Republican candidate for Colorado State House and anti-gay activist filed additional and equally specious copyright complaints that once again terminated the account.
We expect our account to be restored again as our videos are protected speech and call on YouTube to more proactively protect users against copyright claim abusers.

The YouTube account of Right Wing Watch recently fell victim to one serial abuser's exploitation of your policy, though the videos in question were all protected by the Fair Use doctrine. Please remedy the situation by reinstating Right Wing Watch's video account ASAP and publicly modifying your takedown policy or employing mechanisms to flag serial abusers and prevent this type of abuse and censorship.

On Monday, we noted that "Dr. Chaps" Gordon Klingenschmitt was continuing to take a victory lap after having filed multiple bogus copyright complaints against our YouTube account that resulted in our account being terminated approximately two weeks ago.
Claiming that we had been stealing and misrepresenting his copyrighted content, Klingenschmitt said that if we removed all of our videos of him from our account, "then I may be willing to drop the case and forgive them."
As we pointed out, we didn't need Klingenschmitt to forgive us because our videos are protected by Fair Use and we had already filed counter-claims with YouTube asserting as much.
Last night, we were alerted by YouTube that the counter-claim we had filed in response to Klingenschmitt's first bogus copyright claim against our account had been decided in our favor and, as a result, our account has been restored.
Klingenschmitt originally filed a series of copyright claims against several of our videos, so a handful of them are still unavailable but we have already filed Fair Use counter-claims on them and so we fully expect that they will soon be restored as well.
In honor of this ridiculous saga coming to an end, we've decided to post a few of our "favorite" Klingenschmitt videos that he didn't want the world to see:
A little over a week ago, "Dr. Chaps" Gordon Klingenschmitt filed a series of bogus copyright complaints against our YouTube account that eventually resulted in our entire account being terminated by YouTube. Following the removal of our account, Klingenschmitt sent out a press release declaring that we "repeatedly stole, copied, and re-published without permission" his videos and bragging that he had been successful in "silencing their hate-speech campaign."
In an interview with The Christian Post today, Klingenschmitt continued to brag about what he had done, saying that he was forced to get our account terminated because we were supposedly stealing his content and misrepresenting it as our own while removing comments from our videos that voiced support for him:
In an interview with The Christian Post, Klingenschmitt explained that he began filing complaints against RWW "because I got tired of their theft, copyright infringement, and piracy of my original video content."
"They copy my videos and republish them under their own brand and logo, pretending as if they were the original creators, raising money for their cause, and failing to give credit," said Klingenschmitt.
"Then they allow their followers to post comments, including death threats against me, and refuse to delete those death threats despite their admin power and history of moderating or deleting other comments in my favor, which they don't like."
Klingenschmitt also told CP that if RWW halts their alleged piracy of his content and remove the threats from their comments section, "then I may be willing to drop the case and forgive them."
It should come as no surprise that literally nothing Klingenschmitt claims is actually true. The videos we post are not theft or copyright infringement and are protected by Fair Use. On top of that, no reasonable person could ever mistakenly believe that we were the "original creators" of the Klingenschmitt clips, or any other clip, that we have ever posted. Certainly, no rational person would believe that we are the "original creators" of any of the dozens of Pat Robertson or Glenn Beck clips posted to our account.
Furthermore, as we explained before, we do not moderate the comments posted on YouTube, so we certainly were not engaging in the practice of removing comments in Klingenschmitt's favor.
Finally, we already had filed counter-claims against Klingenschmitt's first two copyright claims when our account was terminated. Based on extensive past experience and YouTube's guidelines for handling such claims, we expect that the first of these counter-claims will be decided within ten working days from the date they were submitted. As such, we hope that within the new few days, the first of Klingenschmitt's bogus claims against our account should expire, thus negating the "three strikes" that took down our account and resulting in the restoration of our account and all of our videos.
We don't have to beg Klingenschmitt's forgiveness and hope that he'll "be willing to drop the case and forgive" us because, by the middle of this week or so, his effort to shut us down by filling frivolous copyright claims against us should have run its course. Hopefully our account will be back up and running soon, simply by virtue of us having followed YouTube's standard procedure for challenging those who file phony copyright claims.
On today's "Pray In Jesus Name" program, "Dr. Chaps" Gordon Klingenschmitt was discussing the UK Supreme Court's rejection of an appeal of an Northern Irish court ruling that granted same-sex and unmarried couples the right to adopt children.
While discussing the case, Klingenschmitt put a photo of two men and a baby on the screen so that he could point out that "one of the men almost has his tongue hanging out, like he's licking his chops, like this baby is ours now. And that's fine, you may call that love, but it looks to me a little bit like lust."
Klingenschmitt went on to say that gay couples "crave" to adopt "the children of heterosexual couples" so that they can raise and recruit them into the "homosexual lifestyle," declaring that allowing that to happen is child abuse:
A few weeks ago, the Right was all up in arms over a story claiming that President Obama was forcing the Marines to switch to "girly" unisex hats. The story was, of course, entirely untrue, but that didn't stop "Dr. Chaps" Gordon Klingenschmitt for talking about it on his "Pray In Jesus Name" program today in order to assert that it was all part of Obama's plan to allow transgender soldiers to serve in the military by turning "all of the Marines into an abomination" before God.
"You can't have men in the United States Marines wearing clothing that's designed for women," Klingenschmitt said. "So you know what President Obama's solution is? To make all the uniforms the same. And this is going to usher in the possibility of transgender, cross-dressing men who want to look like women, they'll be able to wear a women's uniform."
Of course, by definition, a "unisex" uniform is neither male nor female so a man or woman who wears one is not actually wearing a uniform designed and designated for the opposite sex. And even though President Obama had nothing to do with it and it's not happening, Klingenschmitt knows what is really going on.
"This is not just a fashion stunt," he said, but rather an effort at "setting the stage for transgender admission of cross-dressing men into the military."
"This decision came down from on high, I guarantee it," he added, "and that's a demonic spirit."
Citing Deuteronomy 22:5, which says "a woman shall not wear a man's garment, nor shall a man put on a woman's cloak, for whoever does these things is an abomination to the Lord your God," Klingenschmitt asserted that this change was an attempt by President Obama "to make all of the Marines into an abomination because they all put on women's clothing":

David Takes Down Goliath -- Anti-Jesus Group Right Wing Watch Terminated by YouTube After Chaplain Files Copyright Infringement Claims
WASHINGTON, Nov. 7, 2013 /Christian Newswire/ -- The anti-Christian group Right Wing Watch (RWW) had their YouTube account terminated today after repeated violations of copyright infringement, theft, and allowing followers to issue death threats against a Christian chaplain.
Former Navy Chaplain Gordon James Klingenschmitt, PhD, who is now a candidate for state representative in Colorado successfully persuaded YouTube to terminate the anti-Christian group's account, after RWW repeatedly stole, copied, and re-published without permission as many as 90 videos created and copyrighted by Chaplain's corporation, The Pray In Jesus Name Project.
RWW has been a thorn in the side of countless Christian ministries for years, quoting out of context ministers like James Dobson, Jerry Falwell, Pat Robertson, and political leaders like Michelle Bachmann and Alan Keyes. Unless YouTube restores their account, years of defamatory RWW video archives against countless Christians have now been deleted, effectively silencing their hate-speech campaign.
"I reached out in good faith to RWW's leadership at People for the American Way, but instead they published death threats against me," said the Chaplain. "I asked them to stop their theft and piracy of my original content, but instead they blogged against me boasting they could steal without consequences."
RWW even mocked the Chaplain here, claiming he didn't know how the internet works, and daring him to file suit.
Instead, the chaplain politely notified YouTube about 6 of the 90 copyright infringement claims, which crossed their limit of 3 claims.
YouTube properly responded by terminating the RWW account and deleting all their videos, causing panic at RWW headquarters, who blamed others for their own arrogance and theft.
The Bible says pride comes before destruction. That's a lesson for them, in how the internet works.
A few weeks ago, we took note of the fact that "Dr. Chaps" Gordon Klingenschmitt was running for office in Colorado, so we guess it should not come as a surprise that he is now trying to cover-up his long record of saying crazy things by forcing YouTube to remove several of our videos of him saying these crazy things by filing bogus copyright complaints.
In the last few days, three of our Klingenschmitt videos have been removed and anyone who tries to watch them simply sees a message saying "This video is no longer available due to a copyright claim by GJK, Inc."
We've run into this issue with "Dr. Chaps" a few times before, like when we posted a video of him saying that Newt Gingrich was under the influence of a demonic voice when he said that Republicans would have to face up to the fact that the public attitude toward gay marriage was changing. When we posted that video, "Dr. Chaps" issued a press release claiming defamation and copyright violations and had our video removed from YouTube:
“Cease and Desist” warnings have been issued to the Huffington Post, Queerty.com, RawStory.com, and the anti-Christian group People for the American Way (PFAW), who are apparently also guilty of copyright infringement and theft of the Chaplain’s copyrighted TV show material.
“These anti-Jesus, Bible-haters have not only defamed me by maliciously misquoting me, they also stole my video, selectively edited to take my words out of context, removed my web-site prayinjesusname.org from my video, and added their own web-site, as if they were the owners or creators of my TV show. That’s highly unethical, and illegal theft and piracy of my copyrighted content,” said the Chaplain.
The liberal bloggers have been given 24 hours to remove their false statements, issue statements of retraction, and remove the illegally pirated video from their sites, or face further legal action.
We filed a counter-claim with YouTube asserting that our video was protected by Fair Use and eventually the video was restored. We have done the same with the three videos that Klingenschmitt has currently had removed and we expect the same result.
The only thing "Dr. Chaps" is doing by having these videos removed is calling attention to his efforts to cover up his well-documented record of making outrageous statements. But then, what else can we expect from someone who clearly does not understand how the internet works?
One thing that you can count on from the Religious Right is that once a talking point has been established, it will be repeated endlessly even after it has been proven to be demonstrably false.
For example, several months ago we wrote a post debunking the idea that Floyd Lee Corkins, the man convicted of attacking the Family Research Council with the intent to kill as many people as possible in 2012, found the FRC headquarters because of a "hate map" posted on the Southern Poverty Law Center's website.
As we pointed out, the map was nothing more than a vague image of Washington, DC and the addresses of the organizations on it were not even listed:
How that vague image somehow directed Corkins to the FRC's headquarters is never explained. In fact, the map doesn't even provide any data as to FRC's actual location, unlike the FRC's own website which provides its address and detailed directions.
It is pretty obvious that nobody in the world would be able to find their way to FRC's office using this map, but that didn't stop "Dr. Chaps" Gordon Klingenschmitt from declaring (23:00 in) on his program today that the SPLC "listed the address of the FRC on their website and that's the map used by the shooter, Floyd Corkins, to go in with a gun and try to kill people at FRC headquarters ... He later told police he relied on the Southern Poverty Law Center map to find the address of his victims."
None of that is true:
On today's "Pray In Jesus Name" program, "Dr. Chaps" Gordon Klingenschmitt interviewed Will Perkins, a long-time anti-gay activist in Colorado who was instrumental in the passage of the state's infamous Amendment 2.
During the discussion, Klingenschmitt and Perkins asserted that "homosexuality is not normal" because humanity would die out of everyone were gay. And since gays cannot reproduce, they must seek to recruit the children of heterosexuals.
"And that's why they're so interested in marriage," Perkins said. "For the access to children."
